Watch out, English speaker

Spanish 'al + infinitive' often translates as 'upon/on doing' or 'when doing', but here it expresses cause, like 'because' or 'since'. English speakers may wrongly render it as 'to' or 'upon', missing the causal link. For example, 'Al tributar como residente fiscal en Estados Unidos' means 'Because she is taxed as a US tax resident', not 'To be taxed...'. 'Independientemente de que' triggers the subjunctive, unlike English 'regardless of whether' which takes a plain verb. English speakers often use the indicative after it, but Spanish requires the subjunctive to show the clause is not asserted as fact. So 'independientemente de que el beneficiario sea...' is correct, not 'es'. In real conditional sentences, Spanish uses the present indicative after 'si' and the future in the main clause, just like English 'if + present, will + verb'. However, English speakers sometimes use the present in both clauses or the future after 'si', which is wrong in Spanish. Say 'Si la promotora intenta..., la Administración procederá...', not 'Si la promotora intentará...'.

Grammar spotlight

Al + infinitive to express cause

B1

In Spanish, 'al + infinitive' can express cause, equivalent to 'because' or 'due to'. It is usually placed at the beginning of the sentence to explain the reason for the main clause's action.

“Al tributar como residente fiscal en Estados Unidos, la artista se enfrenta al tipo general del 24%.”— Due to paying taxes as a tax resident in the United States, the artist faces the general rate of 24%.

⚠️ Do not confuse 'al + infinitive' with 'cuando + clause'; the former emphasizes cause, while the latter emphasizes time.

Independientemente de que + subjunctive

B1

'Independientemente de que' introduces a concessive clause and must be followed by the subjunctive, meaning 'regardless of' or 'no matter'. It emphasizes that the main clause is unaffected by the clause's content.

“Permite imputar la tributación en España independientemente de que el beneficiario formal sea una sociedad de representación o una mercantil interpuesta.”— It allows taxation to be attributed in Spain regardless of whether the formal beneficiary is a representation company or an intermediary company.

⚠️ Do not use the indicative; 'independientemente de que' must be followed by the subjunctive.

Si + present indicative, main clause in future

B1

In real conditional sentences, the 'si' clause uses the present indicative and the main clause uses the future (e.g., procederá), indicating that if a condition is met, a result will occur.

“Si la promotora intenta desviar la facturación inflando los contratos de producción técnica, la Administración procederá a regularizar las cuantías.”— If the promoter tries to divert billing by inflating technical production contracts, the Administration will proceed to adjust the amounts.

⚠️ Do not use the present tense in the main clause; the main clause of a real conditional typically uses the future.

Spanish Non-Resident Income Tax (IRNR)

Spain's Non-Resident Income Tax Law (IRNR) stipulates that non-residents must pay tax on income obtained within Spanish territory. For non-EU resident artists, performance income is generally taxed at a flat rate of 24% on the gross amount, with no deduction for related costs. This system aims to ensure that foreign artists pay taxes legally for their performances in Spain.
